1. Introduction & Acceptance

Welcome to Gutts (“we,” “us,” “our”). These Terms of Service (“Terms”) govern your access to and use of the Gutts app, website, and related services (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Definitions

User / You means the individual or entity using the Service.
Content means all information, data, text, images, screenshots, logs, analytics, and recommendations generated by the Service.
Service includes the mobile app, website, APIs, and any updates or new features.
Personal Data means information relating to an identified or identifiable person, as defined in our Privacy Policy.

3. Eligibility

You represent and warrant that you are at least 18 years of age, or have obtained permission from a parent or guardian if younger, and that you have full authority to enter into these Terms.

4. Use of the Service

You may use the Service only for lawful purposes and in compliance with these Terms.
You shall not use the Service to infringe rights, violate laws, upload malicious content, or reverse engineer the software.
We grant you a limited, non-exclusive, non-transferable license to use the Service as intended.

5. Account & Security

You must provide accurate, current, and complete information to sign up.
You are responsible for maintaining the confidentiality of your account and password, and for all activity under your account.
Notify us immediately of any security breach or unauthorized use of your account.

6. Content, Recommendations & Disclaimers

The Content, insights, analyses, and recommendations from Gutts are for informational purposes only and not a substitute for medical diagnosis, treatment, or professional advice.
We do not guarantee outcomes, accuracy, or that the Service will resolve any health issue.
You should seek professional medical advice for health problems, before starting diets, or when making significant changes.
The Service is provided “as is” and “as available”; we disclaim all warranties to the fullest extent allowed by law (including implied warranties of fitness, non-infringement, and merchantability).

7. Intellectual Property

Gutts and its licensors retain all rights, title, and interest (including copyrights, trademarks) in the Service and Content.
You may not copy, modify, distribute, sell, or create derivative works from the Service or Content (except as allowed through the Service interface).

8. User Content & Feedback

You retain rights to all data and logs you provide (meals, symptoms, etc.).
By submitting content or feedback, you grant Gutts a non-exclusive, royalty-free, worldwide license to use, adapt, display, and improve the Service.

9. Third-Party Services & Links

The Service may contain links or integrations with third-party services (e.g. health APIs, external blogs). We are not responsible for these third-party terms, content, errors, or data practices.
Use of third-party services is subject to those providers’ terms.

10. Payment, Subscriptions & Refunds

If we offer paid features, subscription terms (billing cycles, cancellation, auto-renewal) will be specified in the app.
Refunds are subject to policy terms disclosed in the app.
You must keep payment information current.

11. Termination

We may suspend or terminate your access immediately for any violation of these Terms.
Upon termination, your right to access the Service ends.
Some provisions (e.g. Intellectual Property, Disclaimers, Limitation of Liability) survive termination.

12. Limitation of Liability & Indemnification

To the maximum extent permitted by law, Gutts and its affiliates are not liable for indirect, incidental, special, or consequential damages (loss of data, profits, etc.).
Our total liability for any claim shall not exceed the amount paid by you for the Service (or a minimum cap if you did not pay).
You agree to indemnify, defend, and hold harmless Gutts from any claims arising out of your misuse of the Service or violation of these Terms.

13. Governing Law & Disputes

These Terms are governed by the laws of [Your State / Country], without regard to conflict of law rules.
Any disputes shall be resolved through binding arbitration [or in courts of your jurisdiction], whichever applies.

14. Changes to Terms

15. Severability & Waiver

If a provision is invalid or unenforceable, the remainder of these Terms remains in effect.
No waiver of any breach constitutes waiver of future breaches.
